Terms of Service

Effective date: June 14, 2026

1. Acceptance

By accessing axervate.com or using any Axervate platform service, you agree to be bound by these Terms of Service and our Privacy Policy. If you are using the service on behalf of a company, you represent that you have authority to bind that company to these terms.

2. Services

Axervate LLC provides managed network connectivity, device configuration, and telemetry services for ATM operators. Specific service terms, SLAs, and pricing are defined in your Master Services Agreement or Order Form. These Terms of Service govern your use of all Axervate services in the absence of a separate written agreement.

3. Permitted Use

You may use Axervate services only for lawful business purposes and only as permitted by these terms and applicable law. You must not:

  • Use the services to violate any applicable law or regulation
  • Attempt to gain unauthorized access to the platform or any connected systems
  • Interfere with or disrupt the integrity or performance of the services
  • Transmit malicious code or conduct security testing without prior written authorization
  • Resell or sublicense access to the services without a written reseller agreement

4. Intellectual Property

All software, documentation, and intellectual property in the Axervate platform remains the exclusive property of Axervate LLC. Customer device telemetry data remains the property of the customer. Axervate may use aggregated, anonymized telemetry data for platform improvement purposes.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Axervate's total liability to you for any claim arising out of or related to these terms or the services shall not exceed the amounts paid by you to Axervate in the twelve months preceding the claim. Axervate is not liable for indirect, incidental, special, consequential, or punitive damages.

6. Governing Law

These terms are governed by the laws of the State of Ohio, United States, without regard to conflict of law principles. Disputes shall be resolved in the state or federal courts located in Ohio.

7. Changes

We may update these terms from time to time. Material changes will be notified by email or via the AxConsole portal. Continued use of the services after notice constitutes acceptance of the updated terms.
